No Charges Laid Against RCMP Officer In 2015 Arrest

One Prince George RCMP officer will not be facing any charges after an arrest in July 2015, where a suspect’s leg was fractured.

The potential charge that was looked at was assault causing bodily harm.

Two officers were on bike patrol the night of July 11th 2015. They noticed noises coming from the bushes along Patricia Boulevard, and three of six individuals were arrested by one of the officers for public intoxication.

Another man appeared to act belligerent and ignored police demands according to a report from the BC Prosecution Service. That’s when the officer used force to take the suspect down, injuring his leg.

The Independent Investigations Office were called in to investigate the incident at the time where a report was then submitted to crown counsel for review.

Chief Civilian Director of the IIO determines whether an officer or officers may have committed an offense, before submitting a report to the BC Prosecution Service.

BCPS says there is sufficient evidence to support that the suspect was intoxicated and the officer’s use of force was reasonable given the circumstances.

The report concluded that the available evidence does not meet the charge assessment standard.

“We would not be able to prove, beyond a reasonable doubt, that the officer committed a criminal offense or used excessive force during the arrest.”
