Rachael Weber fined for contravention of Election Act in 2024 provincial election

MACKENZIE — Elections BC has fined Rachael Weber $1000 for contravening the Election Act during the 2024 British Columbia election campaign.

Weber ran as an independent candidate in the Prince George-Mackenzie riding finishing fourth with 435 votes.

In a letter to Weber dated June 1, 2026, Elections BC pointed out that the individual contribution limit in 2024 was $1,450.82. The same letter noted that Weber contravened section 186.01(1) of the Election Act when they contributed $4,900.19 over the 2024 contribution limit to their own campaign.

Director of Investigations for Elections BC Adam Barnes wrote that section 220.05 of the Election Act required him to issue an administrative monetary penalty of up to double the amount that the political contribution exceeds the political contribution limit. The maximum monetary penalty in this case is $9,800.38.

In assessing this penalty, he noted the following:

  • Making prohibited contributions gives a candidate an advantage in that the candidate did not need to seek a contribution of those amounts from other sources, saving the candidate time during a busy campaign.
  • There was no evidence that the campaign acted deliberately to circumvent the campaign financing rules, and it is likely that the contravention was based on misunderstanding of the Election Act.
  • The campaign was notified about the campaign financing rules by EBC.
  • You have not previously been the subject of a monetary penalty under the Election Act.
  • The campaign responded to the Investigator’s questions and has been cooperative with the investigation.

Barnes noted that Weber may request a review of this determination by an Adjudicator.
